Hi Team,

I am an Indian citizen & getting married to an Indian citizen who has applied for Canadian PR.

On her application she has shown herself as single however after submitting the application for PR our family decided that we should get married here in India.

Her visa status is in progress & she have received an offer from a Canadian health care unit.

My question here is that if I get married to her & I can work in Canada & will be getting the same benefits from the government that my wife will get ?

Please check & revert as soon as possible.

Thank you.

If you marry before she becomes a PR, she must declare you in her application. You will need to undergo background and medical checks. If she doesn’t do that, and she lands with single status, she will never be able to sponsor you as a spouse.
If she does declare you and includes you in her application, you will receive permenent resident status along with your wife and will receive the same privileges.

Thank you for your quick response.

What if she lands there with a single status, so can get married in Canada ?

If yes then I'll be eligible for all the privileges.

I am stuck please help.
Will be very grateful.

Thank you.

Sure she can land as single and you get married in Canada but that assumes you would get a TRV.

Then you would have 2 options for her to sponsor you , an outland application with no work permit or inland application with a work permit possibility, although with inland travel outside Canada is not recommended too often whilst in process. In either case the sponsor is expected to be in Canada and processing time could be upto 12 months plus you need to maintain a legal status.

Alternatively if the job offer can wait, unlikely I expect, you could marry in India then she could change her application from single to married, you go through medical / background checks then once completed land together as PRs. Cannot guess how long this might take but expect not as long as option above.

As for privileges you need to be a landed PR for PR privleges whatever you think that means although with an inland application you can at least apply for work permit which might take 4-5 months or so to come through.

As Buletruck implied under no circumstances should you marry and have her land then as single as she would not as a PR be able to sponsor you ever.

Above is my personal view so am sure others will comment or correct me as necessary.
