We've been living with my gf for over a year together. Initial 6 months visa got extended for common law purposes.

Had a big disagreement, I didn't want to go through with the common law and she claimed a refugee status, this application has merit but isn't strong. She'll have a court date soon, and it's a 50/50 from what I understand.

We want to go through with the common law. Does she need to widthdraw the refugee claim for best chance of success with common law ? Her 'lawyer' doesn't think do.
 
There are serious financial implications for you if you sponsor her. If you have already had a disagreement that lead you to cancel your sponsorship I would really think about whether common law sponsorship is the right avenue.
