if you mean the applicant has a civil case pending in court, then no, i don't think that has any affect on the application. generally, CIC is more concerned with CRIMINAL charges/convictions, not civil matters. i would imagine it would be more of an issue for the court if he moves to canada before it's resolved, not an issue for CIC.
