Hello everyone,
I applied for citizenship in June 2014. Right after applying, I left Canada to be with my mother as she is not well due to her age factor. In July my application was returned because it was missing a date on the form. Now I need to resubmit a new application along with a new residency calculator. Now here is the twist, when I applied in June 2014, my residency calculator indicated that I meet the residency requirement. Now as per the new calculation I only meet the basic residency but not enough time of physical presence. I am still outside of Canada and might take another few months before I can come back. I have been on PR since 2004 and have lived in Canada for approx 6 years in different intervals. Also my ex-spouse and my son who are Canadian citizens are also here with me. Please advice....

I think you have less than 1095 days in last 4 years window. If that's the case, try to come back as soon as u can to accumulate more days. The longer you stay the more you'll have to wait before u can apply

Unfortunately, since the application was returned, any new application will be considered from the date. That means, you have to meet the physical days required. Try to come asap and send the application.

You will either have your application returned to you for failing to meet RO or you will get an RQ and can try to explain yourself to a judge with very small chance of success. Dealing with an RQ and seeing a judge is a slow process. you are better off applying when you meet the RO.

Just out of curiosity, what if I still apply with only basic residence?

You could try but you will not likely to succeed. The physical presence in Canada is the main qualifier for Canadian citizenship. You can still maintain a basis residency and be out of Canada for 5 months out of 12. So that is why, it is important to pass the physically presence in Canada to get citizenship. Your best bet is to wait until you come back to Canada, stay long enough to pass the physical presence test and resubmit it then.
