Do not pay the photographer until they get it right. A photo that is not according to the instructions is useless to you. However, since they give you a range of 25 to 35, maybe they feel that's a big enough range for you to be able to make it. You should follow the instructions they give you. It is irrelevant if it fits some frame on the application form or not. You are not gluing it there anyway.
