Changing Status from Work Permit to gain experience.

Hi Everyone,

Currently, I'm working in Canada on implied status. I have submitted a paper based application to give enough time for the LMIA. First LMIA towards my work permit had a negative impact. My employer is going to submit the LMIA for the second time.

I have 6 months work experience so far. I hope I can work for another 2 to 3 months on a implied status until CIC makes decision on my work permit. If my LMIA or Work Permit fails, I have to apply for restoration of status and LMIA application may or may be submitted by my employer.

Based on the above situation, I will be short of 2 months works experience towards CEC Express Entry category.

Question:
1) Can I apply for a short-term course(15 weeks) and work for part-time?
2) Do I need a study permit for that?
3) If I choose a course of 3 months length, will CIC allows me to work?
4) If I choose a course of 1 year length and when I reach 1 year experience with part-time experience, Can I discontinue my course? Would that impact my PR application?

Please let me know your thoughts. I'm so confused.

1) No. The program needs to be more than six months long and full time in order for you to be able to work.
2) No - you don't need a study permit for a 15 week course. But you also can't work.
3) No.
4) No. Work experience gained while studying in Canada cannot be counted as work experience towards any immigration program.

You also have another problem. You most likely won't get implied status and most likely won't be able to count any of the work experience after your work permit expires as experience. CIC is now rejecting extension applications when people apply without approved LMIAs. When you are rejected, there's no implied status and you go out of status the moment your work permit originally expired. This means any work after your work permit expired is now illegal work and cannot be counted as experience towards any immigration program. So in reality, you'll most likely be 4-5 months short in the work experience you need.

Is there anyway I could extend my stay for couple of months to gain some experience? Because, based on my calculation, I would definitely work for another 2 months and when I reach 2nd week of August, I will be completing ~1300 hrs. So, I'll be short of two months experience. Any suggestions to extend my time as a worker would really helpful.

You need an approved LMIA to extend your work permit.

Again, it's quite possible you will not be able to count the work experience you gain while on implied status. So your work experience gap may be a lot larger than two months.

This information really helps. Actually, My first LMIA application was rejected and my employer is not very confident about the second application. So, I had a thought of looking for other options.

Also note that you need 52 weeks of full time work. Having enough hours isn't enough. This means you need at least 52 separate weeks where you worked 30 hours or more. If you worked more than 30 hours in one week, it's still only counted as one week of experience. Make sure you factor that into your calculations to ensure you don't apply too early.
