Hello everyone,

I have applied for OWP and PR under common law , but my IEC will expire during processing, putting me onto implied status.

I was advised to apply for a visitor visa as well, just in case my application was returned and I lost my status. This is so I can remain in Canada and re-apply for OWP and PR whilst on a visitor visa.

The thing I'm wondering is, when/how is the visitor visa activated? Obviously this visitor visa is a last resort, I do not want it to activate unless I lose my implied status if my application is returned for any reason. Do I have control over when the visitor visa is activated?

You will apply for an extension of status as a visitor. It's not a new visa, but an extension of your right to stay in Canada. You get implied status from the application for it.

Ok thanks, but how does it work in this scenario - I'm on implied status as a worker after my IEC expires - application is returned - If I have applied for a visitor visa before my IEC expires will my status just switch to visitor?

Sorry I know I'm planning a worst case scenario here , but better safe than sorry.
 
If you apply for an extension of status as a visitor before your IEC expires, you get implied status. I don't know if you can continue working in this case.

If your OWP app is returned, you still either have implied status as your extension is being processed OR you have visitor status (and would get either a temporary resident permit or visitor record in the mail) and can reapply.

I don't know if you can continue working once your IEC expires even if you have implied status from the OWP applo. Hopefully someone smarter than me can answer that b

As far as I'm aware I can continue to work as long as I have an OWP & PR being processed on implied status.
I'm just trying to figure out if anything went wrong and the PR and OWP got returned, would I then auto switch to a visitor visa (as long as I applied for one).

You don't need an immigration lawyer. Apply for the visitor extension a few days before your IEC expires. Current processing times are 3-4 months. By that point, either your PR/OWP app will have been returned and the visitor extension would be keeping you in status or you would have received the OWP and could withdraw the visitor extension.

Ok that all sounds good. But when I check processing times for inland visitor visas it says 5 days if submitted online.

You aren't applying for a visitor visa. You are applying for a visitor extension.
