Hi there,

My friend is in Canada on a closed work permit Feb 2019-2021. She had an LMIA approved and work permit given for a specific location. She worked there for about 9 months, then the employer asked her to work at a different location because the sole employee at this other location quit suddenly, and my friend was the only one with the certificate to do the job. They were not aware at the time that they should have gotten an LMIA and new work permit for this new location, so she has been working there ever since without these new documents. Recently, the location that she had been working at originally has closed, so she can't just go back (business was bad and the building they were leasing was sold to a different owner). Additionally, the company is under review for LMIA. Nothing has happened yet, but we're trying to figure out what to do next as some people she has talked to said she's now working illegally and can be deported or have her LMIA cancelled.

Would she be fine getting a new LMIA and work permit for the new location that she's currently working at? Does it matter which employer she applies, given the fact that it could be known that her employer asked her to move without checking for a new LMIA? Is it all her responsibility and will she be having a more difficult time with LMIA in the future because of that?

It doesn't seem likely for a PR to get approved as her points are low.
