Dear friends, please help if you have/had similar experience... I'd really appreciate!

It's about changing of marital status while PR application is being processed... i am really confused and worried.

I am currently in a very committed relationship. When i submitted my application end of Jan, however, my partner and i had not been cohabited for one year, so I declared myself as single in the application. And in the LOE, I explained my detailed situation, and told CIC that I will report to them when our status enter into c/law, which will be the late April. This will be earlier than our landing time anyhow.

So my questions are:
1. Will this application be refused due to change of martial status and correspondingly lower CRS score?
2. If not, will my partner also get landing visa in this application, if both of us passed CIC examination?
3. If the answer to Q2 was no, will I still be eligible to sponsor him for PR after landing?
I am worried because CIC said people cannot be sponsored if their sponsor didn't include them when sponsor applied for PR...

Please help.... thanks a lot guys. I didn't find much relevant info here in this forum...
 
I'm unsure about 1&2, but you will still be able to sponsor him if you get PR.

You did everything correctly, because at the time of your application you answered truthfully that you were single. Because you hadn't cohabited for a year yet, you could not tell CIC that your were in a common-law relationship. That would have been misrepresentation.

You did a good job by including the reference letter, which means you were completely transparent about your situation.

It's only when people hide the fact that they are actually married or in a common-law relationship that they cannot sponsor their spouse later. But that's not the case in your situation.

Maybe someone else can chime in on 1&2 - I'm not sure what the exact situation is.

I am in kind of similar situation. i read on a post that after you get the PR you must inform CIC that you have entered into c/law. there is a process where you need to fill some forms and provide documents..takes 2-3 months..unfortunately i cant find that post but please search in this forum and you will find it..

Also remember that once you land in Canada without spouse and then sponsor ur spouse, it takes 18+ months !
 
If you become "common-law" at ANY TIME before you have landed in Canada, you MUST inform CIC that your status has changed from single and you MUST NOT attempt to land.

That's incorrect. If you land as "single" when in reality you are married or common-law at the moment that you become a PR by landing, you will not be able to sponsor your partner. Google for the effects of IRPR 117(9)(d). http://laws-lois.justice.gc.ca/eng/regulations/sor-2002-227/FullText.html

Yes, that's my principle, just follow the truth/reality, being very transparent to CIC, instead of making sth up...

I will inform CIC when we enter into c/law, and see what's the instruction or results following.

hello faridshariff, thanks for the information, I will search the forum trying to find the post you mentioned.

The processing of sponsorship takes 18 months long, it's really painful :(
My partner has Canada visiting visa, so if unfortunately only me get PR visa, he can still stay with me for 6 months, applying for owp etc.

Since we are in a similar situation, could we share our experience and progress under this post? ;)

Thanks zardoz for reminding me on this.
I will definitely inform CIC when we enter into c/law.
After this, I won't land to become PR before CIC give an official response or decision upon our application.

The thing is, we had already booked airplane tickets to Canada and the US this Oct.
(we planned this vocation regardless of the PR application, dual intention...)
If we didn't get official decision before this, can we visit as tourist and land in Canada?
