Hi All,

I have two questions in order to start my application for PR under CEC class inside Canada. Started working in Canada from Jan 2012 but what I got paid was less than what was mentioned in LMO until end of the year. but My salary revised in 2013 and now getting same as mentioned in LMO from Jan 2013.

- I got T4 and CRA assessment which was less as per LMO for the assessment year 2012.
- for 2013, I got everything as per papers. But I did not work for 5 months due to work permit expiration in 2013 that means only I got T4 for 7 months for 2013.

1. Am I eligible to apply PR now?
2. If yes, Can I submit same documents for 2012 beause of inconsistent salary as per LMO?
3. Will be 5 months included/excluded from the 1 year under CEC?
4. Am I under not eligible condition?

I think my case is unusual and it was happened because of my innocence. Please experts help me to how to proceed.

What do you actually mean by possibilities? You can of course apply for CEC provided you satisfied all of the requirements and can provide the proof and application forms in the Document Checklist.

I think so since you've accumulated one year of work experience. And based on your profile under your name, your NOC is eligible as well.

You can submit the documents for 2012 because you are claiming for work experience gained in 2012. LMO doesn't matter. What matters is you gained the work experience and you have the proper papers/permit.

3. Will be 5 months included/excluded from the 1 year under CEC?
The time you don't have a job of course does not qualify for obvious reasons. You cannot claim work experience for the time you are not working :)

4. Am I under not eligible condition?
Check the requirements and document checklist and assess if there is a part that you think does not qualify you.

Agree. Go through checklist and check whether you have all what CIC ask under CEC.
 
My Main concern or doubt, what I have to if the immigration officer ask me about salary conflict based on LMO and T4 f0r the year 2012.

I don't know answer for what you are asking, but if that is your concern than wait till you complete 1 year which is June 2014 I guess for you and then apply. So your 1 experience will be counted as xx-June-2013 till xx-June 2014.

It is not June.

Actually, I have worked in 2013 from JAN/1/2013 to MAY/15/2013 and resumed at work on OCT/10/2013 unitl tiidate

Assuming from the above that you worked for 12 months in 2012, yes, of course.

2. If yes, Can I submit same documents for 2012 beause of inconsistent salary as per LMO?
Yes. The fact that your employer did not pay you enough is your employer's fault, not yours. If the VO even notices the discrepancy between what you were actually paid and the LMO, it will not harm your application (unless it is such a large discrepancy that it raises doubt about whether or not you were performing skilled employment).

3. Will be 5 months included/excluded from the 1 year under CEC?
If you didn't work for 5 months, it cannot be counted toward your experience requirement.

Not unusual. Without more details, I don't see any reason you cannot go ahead and apply. Make sure your letter of employment indicates the 5 months you were not working.
