Hi,

I am currently in a complex situation and hoping to find some help here. I had applied for CEC PR application along with my wife and daughter last year. In between my wife was pregnant and we got gifted with a baby boy in June. I informed CIC and they are asking for a birth certificate.
Now comes the actual problem:

I am planning to stay in Canada only for an year or year-and-a-half. Later planning to go back to india and settle down there. I want to apply for Indian passport for my canadian newborn to take full advantage of all the benefits in India and to avoid higher tuition fee problem during his studies(since it is difficult to pay higher NRI fees with Indian income). Now the problem is during our stay here next 1-2 years, we will travel to India for vacation few times. I want to include my newborn in our PR application.
Will CIC accept my request or deny it saying that the baby is canadian born and cannot be granted PR?
If CIC rejects my newborn's PR inclusion and we travel to India on vacation with newborn having Indian passport, how can he re-enter canada along with us. I dont have problem with me,wife and daughter as hopefully we will get PR. But now the problem is with newborn.

Please provide your inputs if you had been / known someone in a similar situation. Appreciate it Thanks

i don't understand if you are serious or joking with your post.
your new born is canadian citizen by birth hence he is not eligible to become permanent resident,he can't get a PR and doesn't need it.
all you need to do is to apply for a canadian passport for your new born at service canada,you can find the application online at: passport.gc.ca

good luck.
 
you can also get indian passport since the new born parents are indians so the baby is a dual citizen.
by the way why are you applying for PR if you do not intend to live n canada permanently,you will end up losing it anyway if you do not stay in canada 2 years out of 5.

Thanks for your reply. I have a good contract opportunity to take up for 2 years and hence will be helpful with PR. Regarding Indian passport , yes I can apply for newborn's Indian passport but how will he be able to enter canada if we go out? He will not have any visa to re-enter.

Note: He can only have one passport at a time. He cannot hold Indian passport as well as canadian passport.

he will be able to re-enter using the canadian passport just like any other canadian traveling overseas.
if he can only hold one passport at time then he will be holding canadian passport as it is his only way to re-enter canada meantime you can still apply for indian birth certificate and register him with the indian consulate in canada,this will be a good enough to prove he is indian citizen.
 
Hello md4me,

follow the below steps before you leave Canada for vacation to India -

1. Apply for Canadian Birth certificate(BC) from service Canada
2. Once you have BC then apply for Canadian Passport.
3. Once CP is in our hand then go to Indian embassy at Toronto and apply for PIO Card (Person of India Origin)

Once you have PIO and CP for your son he can travel between these 2 countries as long as they are valid (PIO for 15 years and CP for 3 years....don't ask what to do after that you need to renew obviously)

lets not worry about your sons educational expenses right now as you can revoke his Canadian citizenship anytime and change to Indian. Hope my reply helps.

Thanks. I will be applying for his canadian passport and will not worry about his educational expenses , etc right now. Also I think we can revoke back his citizenship once he turns adult( 18 years age ) not before that.
 
You are correct. As he is minor need to wait until 18 or else any OCI/PIO can apply for citizenship after 7yrs/5yrs some period. For now as you decided don't worry and everything will be alright. One more good news for you is not all schools will charge you so much fees for NRI's. only after 11th grade until engg. you may need to shed more but with that amount we can send them to overseas for education (as ppl or doing MS outside). I am also in your same boat and my kid is 2yrs old born in Canada and am in India now from last 1year.
