Hello,

I am on a work permit and have a Incorporated firm which I opened with my business partner in Jan 2015. She is the director and I am the marketing manager. I run the business from my house...so the business address of the corporation is the same as my house address. I recently received an ITA to apply for immigration under the CEC.

I have presently drawing a salary from the firm and have pay stubs, payroll and T4 to prove it. I believe the sole proprietorship experience does not count towards the express entry score.

I have 2 questions:

(a) Will this experience with a Incorporated firm be considered as 2 year Canadian experience in the Canadian experience class? I dont think it can be treated as sole proprietorship...right?

(b) The address in the T4 issued by the company is same as that of my house....will that impact the case in any way?

Sole proprietorship is not the only form of self-employment. Based on what you have stated, you are a business owner.

There's an obscure rule somewhere that I cannot find now, where it depends on what % of the business is yours. If it is 50/50, you will be considered self-employed. But I can't remember the maximum share you can own and be considered an employee.

And of course, having the business registered to your address flags the fact that you are an owner.
 
Why does the CiC website include the following statement for self employed business and incorporated firms:

if the applicant is self-employed, articles of incorporation or other evidence of business ownership, evidence of self-employment income and documentation from third-party individuals indicating the service provided along with payment details (self-declared main duties or affidavits are not acceptable proof of self-employed work experience).
If the work experience is in Canada, proof may include copies of T4 tax information slips and notices of assessment issued by the Canada Revenue Agency (the time period for these documents should reflect the work experience timeframe [e.g., work experience from 2006 to 2008 requires only documents from those calendar years]).

Does it mean that they are willing to accept this experience?

No.

IRCC accepts self-employment for foreign work experience only. If it is in Canada, self-employment is specifically excluded.
