Hi,

My cousin who has come for her PG to Lambton College( Sarnia) last year in December 2013.She wanted to withdraw or transfer it to different school. They sent out an email regarding that..at the time you need to present the supporting documents eg: passport, study permit and acceptance letter. As she is new to Canada, none of her friends helped her out. She went to sarnia Lambton college, as she was not carrying the Acceptance Letter the College reported to CBSA, and the CBSA took her passport and never returned till now. She continued her education with Lambton College till today and applied for Co-Op and waiting for it.

One of her friends suggested her to go to Green & Spiegel Immigration Firm to take up her case. She is been with them they said it will done before December 2014. Still now... Nothing! They are still waiting for the hearing date. As they did not get any information about that.

She really have new clue what step she needs to take? She is married, her husband is in her home country. And she really have no idea how long the process takes. She wanted to get her husband on Visitors visa? Is this a good idea to get him here now?

No one is answering her, not even the immigration firm. For everything, they ask her money. What is the next step she can take? For example: If she has to leave to her home country (emergency) what can she do then.. What happens then?

Please kindly advice guys...would appreciate it!

first and foremost u need to get correct details from ur cousin. like they say half knowledge is dangerous....i think u do not understand ur cousins condition from what I am guessing. but did ur cousin quit her college and remain in canada? what letter was sent to her and by whom? now i am guessing since ur cousin quit college she was out of status am I right? and because of that she was sent a letter to explain? now another question why did CBSA take her passport has she applied for change of condition from student to visitor and hence they took her passport? u need to get correct details.
 
No no! Your understanding whole thing wrong.

Firstly she did not quit the college, she is continuing in the same college( Lambton ). She finished her PG and even applied for her Co-op work permit.

Secondly they took her passport because as she put a transfer to a different college , you need to have a acceptance letter as such, she did not have any at that time....so they took her passport!

very confusing.....she completed her college got a PG diploma and applied for post grad work permit am i right? i dont think she could apply for coop work permit. secondly did she send application to extend her study permit without an acceptance letter? how long has it been since she applied for extending study permit. to transfer college one does not need CIC permission so i am guessing she is extending her study permit and her study visa.

Right now her problem is how to get her passport back from CBSA?
1) She doesn't have any status problem.
2) she did continue her education in the same college,she has all the proofs if she needs to fight.
3) Co-Op is nothing but an Internship, which college permits.
4) Her study permit has no issues too.

u said she finished her PG and applied for coop work permit hows that possible? coop work permit is for those who have internship as part of their education so if she finished her PG how did she apply for coop work permit. i am trying to understand the situation why CBSA took her passport did they say why they need her passport?

She had to give her passport as she wanted to transfer her course to a different college. As Lambton has a certain request . She did abide by this rule, so they had to complain to CBSA... Then they have taken the passport.

Looks like a student was not 'registered' for any courses initially for a long time. Lambton reported the student status to CIC (new rules), and CBSA randomly picked up the matter.

ye i figuerd that but what confuses me is they took her passport ....something is missing

I dont understand how anyone can live in Canada without their passport....??
Where is she from?? Country of origin??
maybe CBSA is looking into other things?? Are you sure she stayed there legally.
I know Green & Speigel Law firm.....they are good.......Mr.Ravi Jain is a top lawyer.....I don't know why the are delaying the case.
