Hiya,

I was studying in London (2004-2008) as an International Student, when I made an application for Federal Skilled Worker category in 2007. I completed my education and came back to Pakistan in 2008. Now CHC, London has sent a letter at my London address requiring me to submit document for the processing of the case.

Now I don't have any UK visa at present and can't go there.
(1) Can they decide my case favourably in my absence?
(2) If not then will they transfer the case to Islamabad, Pakistan? Process in London is speedy than that of Islamabad, Will i have to wait for more time in Pakistan or they will process my case straight way?
(3) Can I send my documents to London including Passport?
(4) How can I get Police Clearance from UK Police Authorities?
(5) Can my UK study can help me in exepmting me from IELTS exams?

Should you not have informed them of the changes in your situation as stated on their website?
Why did you not update CIC London?

Well, all I can advise you to do is write them ASAP and inform them, if not you may get a decision for "non compliance" or something unfavorable.

(1) What makes you think that?

(2) Why would they transfer a case if the applicant has never asked them?

(3) Sending your passport through post is illegel and that alone can disqualify you from getting PR.

(4) You have to contact the UK Police, however theres a fee to pay for clearance certificate.

(5) CIC strongly suggests that you take IELTS if your native language isnt Engish. I know it sounds unfair but why give them an excuse to refuse your application especially if claiming full points for language puts you just over the borderline of 67 points.

Please advise me the future of my application if I could get UK visa before the due date of submissin of my documents?

That was the one of the reasons I did not inform them about change in address.
I will apply for visit visa for the UK if I get then I will travel and will submit the documents there. If I could not get a UK visa then I will send the copies of documents, as they don't need original passport and documents at this time.

Other reason for not changing the mailing address was that one of close friends is living permanantly there in London and can let me know if any thing happens there. Is it a good justification for not changing the address?

No, I am afraid its not.


Also, as per CIC rules if you are applying from a country different than your home country, then you should be residing (not 'visiting') in that country at least for the last 12 months. Mate, if I was you I'd seriously look into changing my address with them a.s.a.p. if you want to play within the rules.

I dont think you need to worry too much. If you have studied in UK, which you did, then getting uk visit visa should not be difficult for you. In fact You dont need to come to UK now to submit your documents.
Just send the CHC London the requested documents. I know one guy, who was in similar situation got his visa in december 2008.
They will not transfer your file to Islamabad. After sending the Doc, you will get medical request. You can do it in Pakistan.The only problem in the whole process, i think, is sending your passport from pakistan. you can always give it to a friend with an authority letter, that is obviously if you dont get the uk visa after your Passport Request.
One thing more, if your FIRST STUDENT VISA was valid for atleast 12 months, and you fulfil the criteria,believe me you will get your visa.

Forgot to mention, even if you have done your phd from uk, still you need your IELTS. It is compulsory. Do not take any chance. Take IELST as soon as possible.

Thanks for your valued advice. I stayed in the UK for more than 3 years for studies therefore therefore there is no problem for me in applying from there. That why CHC, London accepted my application. I am trying to get UK visa and hopefully I will get it and will visit the UK.`

Anyhow I have let CHC, London know my new address in Pakistan and hopefully there will not be case of non-compliance.
