Hello All,

I have cousin whose work permit is expiring in Jan 2026 and planning to start his payroll after Sept 2025 (My wife is expecting and delivery is due in Sept 2025).I have following questions regarding caregiver program-

1. My parents will be here in super visa in July 2025. My question is while calculating minimum income requirement, Should I calculate income based on 5 people ( Mom, dad, wife , myself and child) plus income that I will paying to my cousin or 3 people ( wife, myself and child) plus income to cousin
2. In future while sponsoring my parents for PR, Will this helping cousin will affect application in any way ?
3. Do I need to add cousin as family member while calculating minimum income for parents PR sponsorship ?

How will starting payroll in September help your cousin for caregiver program?
1. Take out parents. You want to meet LICO for 3 people plus show that you can pay and afford a full time caregiver salary.
2. No. Have parents even been invited.
3. No. Cousin is not dependant.

It will be opening a new corporation and transfer money from personal account to new corp account and then transferring into cousin's account. I am not sure whether this is right way. Please advise if we can proceed this way or we can do other way

So if your parents are not even in the current 2020 pool then PR is years away if even invited. Yes, you need a business account but how is your cousin eligible for program. Assume in caregiver field already or went to school for it.
 
Cousin is looking to extend work permit. Read it online and read below for elibility for LMIA-based work permit

Do you have an LMIA as an employer?
 
No, We discussed this case with immigration consultant and he mentioned that you just need to open a corporation and start his payroll. I found this fishy that is why discussing to get clarity.

I am working on pay roll for some other company and I think simple answer is that cannot sponsor him. Please correct if I am wrong

Are you in Quebec? Their WP expires in January so what is your cousin’s longterm plan? Do they have education/training related to being a caregiver? Do they have work experience as a caregiver?

No , I am in ON. He doesn't have any work experience or education in regards to caregiver.

He is just exploring option to extend his work permit now as a future plan

So he is not eligible to extend work permit. Having a job offer and you starting a corporation doesn't allow him to extend it. You cannot hire him past January, and he needs to stop working. So will not be eligible for the program.

You cannot apply for a LMIA for a caregiver. Assume you have posted the job to job bank and other sites to prove you cannot hire a caregiver who has work authorization/citizenship/PR in Canada. You want to show you cannot hire someone with experience too.
