Hello Members,

I am a Canadian citizen with a one‑year‑old baby, and I would like to ask for guidance regarding the Caregiver LMIA process for 2026. Specifically, I am wondering whether it is possible to apply for a caregiver LMIA and hire an extended family member to care for my child.

Thank you in advance for your assistance.

How long have you posted the job on job bank and other job sites? What is your NOA? Is family member working in Canada? Are you in Quebec? What is salary and location? If person is not working in Canada now and you are not in Quebec then no. If working in Canada then does your family member have experience, education in the field and language test results. If family member is in Canada, then you want the position to be high wage (need to post this on Job Bank and other sites) if want more than a one year work permit.

I haven’t started the LMIA process yet. My immigration consultant told me that this case could still qualify for a work permit, but I’m not fully confident that the information they provided is accurate. That’s why I posted this thread to get clarification.

My family member was previously on an open spousal work permit, but it has now expired. She has applied for visitor status and is currently waiting for a decision. We are located in Ontario.

She does not have any caregiver‑related education or experience, but the consultant mentioned that she can obtain the required education while the application is being processed. She does have valid language test results (IELTS).

So how long have you posted the job in Canada? The link provides the information that you cannot hire someone without a work permit. How is she taking a caregiver program without a study permit as program has to be 6 months or more to qualify? So she has no experience and education, and you have proven that no one in Canada (on work permit, PR or Canadian) can do the job? Hiring a family member is highly scrutinized as it seems like a scheme to keep family here when not eligible for PR, study permit etc.

You should already have the qualifications before you apply for a WP. Also assume you have an extra ~40k annually to pay for a caregiver.

Yes, the $40k requirement isn’t a problem. My question is whether I should begin the LMIA process now, and in the meantime, she can start working on obtaining the necessary qualifications.
What's your thoughts ??

Thank you!!!!!!

Did you even read the above link?

If you are submitting an LMIA application on or after June 18, 2019 with the intention of hiring a caregiver from outside of Canada for a position located outside Quebec, please be advised that Immigration, Refugees and Citizenship Canada will not issue a work permit to the foreign national allowing them to work for you.

In most cases, the foreign national(s) that you name in your LMIA application must already be in Canada with a valid work or study permit in order to be eligible for a work permit based on an LMIA.

So how is she eligible? How long have you posted the job on job sites? How is she getting necessary qualifications as a visitor in Canada.

And it sounds like that you’ll give any reason not to hire qualified individuals and only hire your relative

Since you’re already jumping the gun on the necessary qualifications
This is why the Government scrutinizes these
