Hi All,

I'm a H1B holder in USA ( working for USA Employer) ( I'm Indian Citizen ) and my fiance she is a Candian Citizen ( working for Candian Employer ). We both wanted to live in Canada after marriage.

Here are my questions:-

1. We both want to registar our marriage so that I can start my PR ( Permanent Residence for Canada ) process ASAP, so my first question is Can we registar our marriage from USA or do we need to go to India for marriage registration process?

2. How long it takes to get my Canadian PR ? approximately~?

3. Can somebody share links or your their thoughts for the steps or procedures to file up my PR after marriage registration? ( Documents, etc etc )

4. Can somebody point good law which we can hire for our procedure?

1. You do not have to go to India. Most of the states in the USA do not have a residency requirement to get married. You can check on your county website for more info ( ie: how to apply for marriage lisence, waiting period, residency req etc).

2. Processing time depends on the Visa office you are dealing with. I presume you may choose to apply in India or Buffalo, as the rule is you can apply in the country where u r a citizen or in the country where u r residing and are legally admitted. You may want to check on the CIC website on the processing time and the procedure. I know it takes abr 3-6 mnth avg in ND. Not sure abt Buffalo.

Your wife will have to mail the application to Missisagua, and they will assess her eligibility sponsor and then forward ur application to the VO.

There is another way....If you move to Canada, she can apply through an Inland procedure. I think you get a work permit but your PR takes abt 18 mnths...not a 100 % sure though..

3. Get the application pkg for your region on CIC website or order it through the call centre. Read every bit of it.
Usually the documents needed are : marriage cert/ birth certificate of the applicant/ school, college records/ employement letters/ police clearence / medicals/ passport pages/ Opticon C print out of ur sponsor/ enough evidence to show ur relationship is genuine!

4. not sure what u mean..r u looking for a lawyer? Spousal application is quite straight forward. You may read from this forum that a lawyer cannot do anything with the processing time. They only help u to send a solid application. Gather as much as proof you've got to show your relationship... arrange your application in a presentable manner....make sure all the documents are there and all the forms are signed..
