Canadian citizen w/ US green card wanting to return with US common law partner

I am a Canadian Citizen and have been a permanent resident (green card holder) in the US for almost 10 years. I would like to return to Canada with my US common law partner
What do I need to do, which class so he can also work? My parents will allow us to reside with them in BC. Should I start the process while still in the US? I am near DC.
Also I am still married previously to another US citizen and am not yet divorced; will this present a problem?
