Hi everybody.

My name is eduardo , am mexican, writing to you from mexico, I was in canada and seeked refugee asylum, it was 2003 at the time when I began my process and case.
While me and my wife were there in that process, our baby was born in Toronto, ON, she was growing up, a happy little baby, two years passed until my hearing at the RPD was scheduled. unfortunately the judge found my case useless, he said that I lied and he denied any refugeee protection to me.
I appealed to the federal court of Canada, but it was the same, they turned us down, we felt unwanted, all doors were closed to us ( I hired two inmigration lawyers, who never helped me, they only took my money).
I decided to come back to mexico in 2006, voluntarily,I was never deported, just when president calderon was running for president, little I knew what was coming.
There's been mass murderings at the town we live at, I called the Canadian embassy here in but they give me websites , I tried to explain to them what was going on but they only process visas and passports, I have written to many but there is no help.

Our situation is this , I was thinking that if my baby had the blessing to have been born Canadian, why should she be suffering all this here in mexico, just because her parents are mexican, she is danger when going to school, to any place, this killers here shoot at any given time, in front of schools, hospitals, restaurants, there was this massacre just a few blocks from were we live, .... I read all over the internet and inmigration sites that canada is a sanctuary to people in danger and yet, my daugther that is canadian can't get help for her and her parents, NOW.
Finally, do you think is possible that she, 9 years of age, could ask fo a refugee claim to her own country, Canada for her protection and her parents?

SINCERELY

Eduardo

No - your daughter cannot file a refugee claim because she is already a Canadian citizen. She also cannot sponsor you because she is too young and parent sponsorship applications are not being accepted at this time.

Do you or your wife qualify to immigration to Canada as skilled workers? This is probably your best option for returning to Canada.

Hi there, thanks for your reply.

however, this situation isn't about age, it is about safety, what I wrote is happening as we speak around here, beheadings, hangings, mass shootings, horrible...

we have moved from one state to another, its all the same in the whole country, is kind of a nazi extermination thing.

Since your daughter is Canadian, you have the option of sending her to school in Canada. Perhaps you send her to this school for boarding and continue her studies:

BTW, what makes you think Canada is safer than Mexico? This one is horrible:

All am trying to get for my daugther is JUSTICE, FREEDOM.
Do you know any journalist who would like to make a story out of this tragedy?

I don't know any journalists who would be interested in your story. I supposed you can try contacting newspapers directly. However you're not going to be granted PR because of a newspaper article.

If you want to apply for refugee status, you and your wife will have to apply. Your daughter does not qualify to apply. Information about applying for refugee status from outside of Canada is here:

http://www.cic.gc.ca/english/refugees/outside/index.asp

To the best of my knowledge, you don't qualify for Humanitarian & Compassionate Consideration because you aren't in Canada. However you may want to read through the instruction guide to verify:

http://www.cic.gc.ca/english/information/applications/handc.asp

If you haven't done so already, I would strongly encourage you to read through the various skilled worker immigration programs available. If you or your wife qualify as skilled workers, this would be another way to move your entire family here:
