Hi! Please I need help!
I’m applying for a spousal sponsorship, my husband is Canadian
I was before asking for asylum and it was denied after appeals and because of that I lost my status, we start the sponsorship just months after and we completed all the steps that are required, we are supposed to be in background check and this weekend I received a letter from the border of Canada that they are calling me for an interview to update my file!! We are really nervous and anxious because we don’t know what this means, please if someone knows something I would appreciate your help!!!

Did you get AIP for your spousal sponsorship ?

AIP is Approval in principle. It's when the applicant have a partial approval to become Permanent Resident. They need only to process your background check before a full approval. I have not idea what kind interview you are talking about it. You should be more clear about the steps that you have done and plus the type of Letter your got it.

The letter is from CBSA asking me to go for a interview in person to “update my profile”, the information I’ve been reading on the internet it says is because I lost my status and they want to know what I am doing and if I’m still being with my husband, to decide if they let the process to continue.
I’ve done all the steps with my lawyer, from AOR to Police certificate, biometrics, everything, we were just waiting for the approval, I also received the CSQ because I’m in Quebec, we have everything done besides the background check and approval of PR

Assuming you filed the Inland sponsorship application, since the requirement to have legal status is waived. However..until you reach the all important AIP (approval in Principal) step, you are at a greater risk of having `issues'.

The interview is likely to determine whether you can remain in Canada during the sponsorship application and if you can remain in Canada what regular contact schedule will be required with CBSA. The fact that you applied in Quebec creates more of a problem because processing is longer and depending on when you applied it could be over a year until your sponsorship application is fully processed.

Thank you for your answer, I have one year completed in the process, at this point we are just praying to God to let us continue with the process after the interview, my husband has suffered mental health problems to the point he had to stopped to work before meeting me so I pray they will consider that, and the fact we are together and I’m a home stay wife and he’s putting all his effort at work to make it happen, this marriage is so real and he’s the love of my life that I really pray everything will work on our favor with God’s help

Can you clarify if you have AIP or not? It sounds like you might not?

I haven’t received that notification from my lawyer but I have meeting with him on Friday to clarify, I’ll take with me more evidence and letters from people that confirms our marriage and pictures, I’ll also try to take my husband’s medical history that proves he was in a big depression before, I hope that will help in our favor in case I don’t have AIP yet

You don't need to bring, or provide, any additional evidence to your lawyer! IRCC will ask for more if they are doubting your relationship with the sponsor. Your lawyer needs to guide you on how to deal with CBSA right now, not IRCC.

Look through section F (Administrative deferral or removal).

Here's the important part for you:

Regulatory stay of removal​


The regulatory stay outlined in R233 will apply to cases considered under the public policy after a positive "step one" or "approval in principle" decision has been made under the regular procedures for the Spouse or Common-law Partner class.


This regulatory stay applies to removal orders if the Minister is of the opinion under subsection 25(1) of the Act that H&C or public policy considerations exist. For cases considered under the public policy, once a positive step one decision is made under the regular procedures for the class (i.e., CIC has received an application which contains evidence that the applicant is married or in a common-law relationship with an eligible sponsor, is living with that sponsor and that the sponsorship submitted is a valid one), an R233 stay will be invoked and will remain in place until a decision on whether to grant permanent residence is made.

Because you have not reached the AIP stage, you may not benefit from this policy, which is why your lawyer needs to advise you on how to deal with the CBSA request. The obvious answer is that you probably need to meet with CBSA as you do not want to get on their bad side.

Since you stated (in a different post) that your asylum claim was denied, which led to you losing status, this makes dealing with the CBSA question all the more important, IMHO.
