Hi Everyone!

I am currently getting ready to apply to sponsor my husband under family class to come to Canada.
- He is an Albanian citizen
- Previously deported from Greece twice, detained 5 times total

We have been working on filling out the paper work, getting phone records, skype records, translating emails and all of that other fun stuff since the summer and now have everything together and are just waiting on one more document.

My question is:
My uncle owns a business, and has sponsored many foreign workers in the past. He has offered to sponsor my husband as a worker, which he said in his experience takes around 3 months, and he has never been denied.

Are we able to apply for both a work visa and the family class? If so which would we submit first? Is it useless to apply for a work visa when my husband has been deported from Greece before?

Obviously we want to go with whatever option would get him to Canada fastest, being separated is horrible and heart wrenching as I’m sure many people know.

Looking for any advice or suggestions people are willing to offer. :D
 
Very unlikely that he would be accepted as a temporary foreign worker with the deporations and detentions. Sorry. It's not your uncle that would be denied. It's your husband because of his past immigration history. You can overcome the history with an application to sponsor him as your spouse for PR but it would be almost impossible for them to overlook it for a temporary work permit.
 
Thank you! I kind of figured that would be the case, but thought it was worth asking. Hopefully with the spouse sponsorship we manage to overcome his deportations and detention stints. Thank you for your response, its greatly appreciated.
Also I see that you are a champion member, and have many stars which I’m hoping means you are really knowledgeable. How would we go about overcoming his deportations and everything? Or is the only way to deal with them to explain them? For our application that’s the only thing I am really worried about.

First, you must be honest about them and advise CIC of the circumstances. Get the records, provide translations and advise that no criminal activity was involved other than overstays. Be 100% upfront about all of it at the beginning. You must compare his criminal record checks to ensure that no offences occurred that would be considered offences under the Criminal Code of Canada. If there is nothing "criminal" in his activity, it should be ok.
