Dear friends;

Is there any possibility of upgrading the application submitted in old system (march 2007) to current system? If yes, does the process complete in period of 6 to 12 months or takes the older time frame of 48 to 72 months? The file number has already been received and the application submitted at that time was as college lecturer (which falls under the NOC 4131 of new system). The application was sent by myself without hiring any consultants/representative.

You can not upgrade it but you can withdraw it and apply again or just apply again and have two applications running at the same time. There are no official timelines for the new applications yet. The goal is 6-12 months but I don't think they are reaching that yet.

Thank you for your suggestion. But the case is that, they already sent me a letter for withdrawing the application if I wish to do so which was prior to the new system. The time frame they provided to me to withdraw the application has already been expired.

Did you reply to that letter? If you did not reply then they will assume you are interested to maintain that old application and they will not issue REFUND order again even if you withdraw this old application right now because that time frame has been already expired. You can apply again under new rule and this new application may be got approved sooner than that old application but you cannot get old application fee refund. This means if it worth to get your PR status maybe sooner, then you should pay again and apply now.
 
You aply fresh NS office,(assuming that you fulfill creteria)
If your first application gets cleared then withdraw second one,If second application gets clearedthen withedraw first one.
Even if you do not do it then visa officer will ask you to withdraw the one whichis still pending.

You are always allowed to withdraw your application. The question is only if you get the processing fee back. Since you will not get the processing fee back anymore, you might as well keep it running. You can apply again under the new system and have both applications running and once one of them is going somewhere, cancel the other one.
 
It's up to the Candidate/Applicant.
If you reapply, you loose $550.00 for a single applicant or if there were 2 Applicants , you will loose $1100.00.
If you don't care about the money and/or are very desperate, you are better off reapplying under the new rules.
However, as mentioned earlier on, you will loose one Application fee anyway.

What do you think why they sent those letters? Nowhere, was it mentioned about the new list and rules. Obviously, the onus was on us old Applicants to find out what was going on and what the latest was all about.

For some, it was a blessing, while for some it was bad luck and that's life!!!
