Hello,

I am on H4 EAD. I have a remote job in US. I am a Canadian PR. I did soft landing in Canada in March 2019, stayed in Canada for few months before moving out to US after getting married. My PR card expiry shows as April 2024. Now I am thinking of working remotely from Canada for this US employer for few months as GC is still uncertain for my spouse. Can I do that? Is it legal? How long can I work from outside US legally?

I also want to make sure that the PR day count starts from medicals date? Or soft landing date?

Please respond to help me out.

Thank you.

You can do remote work from Canada. There is no illegal for a US company to pay someone outside US. Companies can legally recruit directly from outside. There is no illegal about offshoring work.

People have different opinion hence its between you and your employer.

Residency clock ticks from landing date. i am not sure what medicals date are you talking about but its only from landing date you become PR.

Thank you very much for quick reply. My question is can my employer continue paying in US and I work for few months from Canada? Will it be legal? I mean can I work without letting my employer know. I don't want them to feel it is complicated.

Since its a remote work its less complex but not sure if you have any constraint on work location/agreement with your employer. So its based on that.
If there is no issues then you can. if not then contact a lawyer to see if you can work from outside since you would loose lot of money if just quit, instead consult the lawyer and proceed. Also without job it will be too boring to spend the day.
Switching/Finding new remote work also is pain. So think and get advice if required.

Is your husband leaving the US as well at the same time?
