Hi,

I have created application in express entry for PR and waiting for the express entry draw results to go just a few points lower to get an ITA.
If I get ITA and subsequently receive Canadian PR, can my spouse (who is not part of express entry application) come with me to Canada as my dependent? Which visa class would he be on? Will he be able to work and look for a new job as my dependent?

Eventually, we plan to apply for his PR through spousal sponsorship.

Thanks
Aditi

No, being a spouse/dependent of a PR or citizen gives no route to a work permit.

Once you sponsor your spouse for PR, only then can they get a work permit (if you apply inland) or can work after they become a PR.

Of course even though your spouse is not getting PR with you, they must still be listed as non-accompanying in your app and pass full medical exam.

Thanks for the quick reply!
Could he instead apply for an Open Work Permit so that he can come to Canada quicker than going through the PR process? And once he is in Canada on the Open Work Permit Visa, we can apply for his PR?

OWP requires that the applicant is already in Canada, and then an inland PR app is submitted at the same time as an OWP app. You can't apply for the OWP from outside Canada.

ONE SECOND.....
If you currently have a spouse, you MUST include her in your Express Entry profile. If you declare him as Non accompanying, you still have to include his details.

Not including his details in EE profile is regrded by CIC as FRAUD.

A case on the forum here was of a married couple who was still boy-girl friends in their countries. They got their sponsorship application refused because the sponsor did not declare "Common law relationship" in her PR application. They were still not married then.

MAKE SURE YOU INCLUDE YOUR HUSBAND DETAILS IN YOUR PR APPLICATION TO PROTECT HIS/YOUR IMMIGRATION RIGHTS.

@Wildermom: In my express entry profile, I have declared my marital status as 'Married' and also mentioned the size of family as 2 (includes me and my spouse).
However, it was not required to mention my spouse's details (name, education and work history etc.) if I declare him as non-applicant. The only issue is that our CRS points reduced by 6 if we included him in the application (he has exact educational credentials as mine and do not receive much points for a bachelor's degree for a spouse). Hence, we decided to apply for one only to get higher points in CRS and if one of us gets through, we sponsor the other one.

@ROB_TO: Thanks for the reply!

It is strange that you don't need to mention your spouse's details (name, education and work history etc.)
You should double check in the Express Entry section.

In one of the EE discussions, I saw this comment from an experience member, scylla.
"You MUST include your spouse in the application and EE profile. This doesn't mean that your spouse must migrate to Canada when you do. If you are selected and are asked to submit the PR application, you can list your spouse as "non-accompanying" which means that your spouse will not be issued a PR visa when you are - and allows you to sponsor your spouse later once you reach Canada. However either way, you must include your spouse in your application and must include your spouse in your EE profile. "

MAKE SURE TO INCLUDE YOUR HUSBAND DETAILS PLEASE, AND CHECK HIM AS NON ACCOMPANYING . THIS IS VERY IMPORTANT.

Sorry for the sharp tone btw, but it is critical to your plans.

Hi ,
I am super confused about the spousal sponsorship visa rules . My fiancé just got his PR and we plan to get registered in Canada pretty soon . Before the registration I will have a work permit in my hand .My question here is as soon as we get registered do I also automatically become a PR holder?. I am very clueless about the documents required especially when it comes to financial papers . I as a dependent spouse of a PR holder need to show 25000 CAD approx as a financial security?. What is the financial requirement that my soon to be husband needs to show ?.. His non -liquid and liquid assets of a certain amount?..
Please help me out anyone who seemed to have understood my questions.

No - you certainly do not become a PR holder automatically. He has to sponsor you for PR. Start researching the process here: http://www.cic.gc.ca/english/immigrate/sponsor/spouse.asp

Thanks for your reply ..
So let me understand this ,whilst I have applied for a PR through the spousal sponsorship route ,I can apply for an Open work permit subject to it being approved ?. My main concern is that if I am on the spousal sponsorship program do I need to keep a certain amount of savings in my account or it’s the sponsors job to do that ?.
Some of the questions seemed repetitive but I need some clarity .

I am an accompanying dependent applicant and me and my spouse plan to land together. Can I bring the dependent land and start searching for a job and start working there, right after we land ? Or there Are some other formalities to be taken care of ... ?

Obtain a SIN Number from Service Canada first.

Yes.... That will be done at the airport itself... but my question is.. after obtaining SIN, I'll be good to go for job hunt and work, right ?
Yes. Good luck!
