Hi

I'm a declined claimant for Refugees, however, when I try online assessment for Skilled Worker Qualification and totaled 72 points.

My questions is am I able to apply under Skilled Worker Scheme while waitng for further instructions from CIC?

Your input will be very much appreciated!!
 
The skilled worker program is waiting for new rules which haven't been published yet but they are already working by them so you can't bypass it by applying now. I would wait a couple of months for the new rules to see what will happen. You could try for QSW if you speak French. You could also try to get a job offer and temporary work permit and an employer who is willing to apply for PNP with you but since you tried to claim refugee, you have already said you want to stay in Canada so that might affect you trying to get a temporary permit.

Thanks for your prompt reply, I've already been working with my current employer for almost 2 yrs. I've just got promoted and recognised as Employee of the Year.. I can see my career is somehow taking off.. the only thing that is stopping me right now is my status.. May I just ask where am I able to find out the updates on the new rules? is it on cic website? I can ask my employer if they can apply PNP for me.. but what does PNP stands for? Please advise...

I've just got my PRRA application... guess I've to leave before all these new rules applies..

PNP is a provincial nominee program. Each province has their own rules but if you are a skilled worker and your employer supports you, normally you can get PR. You can go to http://www.cic.gc.ca/english/immigrate/provincial/apply-who.asp to find the PNP of your province and see if you qualify.

If you have been on a skilled permit for 2 years, you can also apply through CEC, see http://www.cic.gc.ca/english/immigrate/cec/apply-who.asp

There is very little on the CIC website about the new rules for FSW but they have said that they are already applying them to applications since February this year even though they don't know what they are yet, basically leaving skilled worker applications on hold waiting for the new rules.
 
Hello Leon. I need your advice please. I am also a refugee claimant that was just denied. This was last week. But I have been here for a year and half now and I am a licence electrician. I have my red seal certificate. I am also a Bachelors Degree holder from my country and my certificate has been evaluated by ICAS and found equivalent to a bachelors degree here in Toronto. Can I just go ahead and apply for PNP with my employer if they agree or I can do that myself? I have a work permit that still has about 2 years validity. I don't want to go back to my country. Lest I forget, I just got a certificate in HAZARD ANALYSIS CRITICAL CONTROL POINT (HACCP) and I am qualified to be a food safety coordinator in any food plant. Please help. Thanks.

1. As you have been refused last week, then you are not longer entitled to a PRRA. So the removal order that was issued, will become a deportation order in 30 days.
2. You will have to apply outside Canada for your PNP certificate.
3. It is unlikely that you would be issued a work permit to return to Canada, with the failed refugee claim.
 
Are you saying I can't appeal the decision of the board? And why did you say I am not entitle to PRRA? Again you said it is unlikely I get a work permit to come back to Canada. Are you saying that even if I apply for PNP outside Canada it will not be granted? Please clarify all these for me. I am more confused with your answer than before it.

If you apply for PNP outside of Canada it will be granted if you qualify and are approved. What PMM is saying is that it's unlikely you will be approved for a (temporary) work permit.

I just finished reading the new PRRA guidelines that takes effect from August 2012. Thank you for the information.
But I saw on that page that I can appeal the decision of the IRB to the Federal court. Is that right?

Your work permit, if you read it, says " does not confer status" also, a decision has been made on your claim, so your permit is no longer valid.
