Hi All,

I am a muslim lady with kids in desperate need of some valid and good advises about the Quebec immigration. If you wish to help and have the adequate information please read this and help me out:

- I have applied for quebec immigration and received CHQ as primary applicant. My husband is the secondary applicant.
- I have had lots of conflicts with my husband and i just wanted to get free of him as he did not let me take the immigration; so i flew to Quebec with my kids and living here since 2 months. I was accepted as primary applicant. There has been no issues in living here.
- My husband everyday threatens me thru emails to file complaints against me in police and harassing me in different ways to go back.
- He can't immigrate because i hold his CHQ papers with me.

Here are my questions:

- I don't want my husband to immigrate to Quebec to create trouble for me and i want to be free of him. So is there any way i can deny immigration to him by contacting some authorities so cancel his secondary applicant status and immigration?

- How can i approach and whom to be approached to do the same and is that legal?

- What legal ways are there to stop him from coming here with my immigration profile?

- Will this affect my immigration in some way?

- Is there any human/women rights commission to approach, who can help me out in Quebec?
 
1- The normal process:

A primary applicant can at will withdraw his wife or her husband from the process. No problem here.

The issue here is you'll need a signed notarized paper from the husband stating that he allows you to take the kids with you.

2- now in your case,

I don't think you should follow normal routes. Instead contact authorities in Quebec and tell them about your situation and that you're being threatened sure they'll be a way.

If you change your husband to non-accompanying, he will not be able to immigrate with you. However, and this is your BIG problem, he would then need to give legal permission for the children to immigrate with you. The only way around that is for you to go to court and obtain full legal custody of the children.

IRCC cannot allow children to immigrate without that proof because it would violate the Hague Convention on international parental kidnapping.
 
Has your husband taken and passed the medical and also provided PCCs? Your application cannot be approved without him passing the medical and security/background checks (even if he's non-accompanying).
