Hello,

Would anyone know the answer to the following?

Family sponsorship in Canada -the application has been sent to the embassy overseas a couple months ago so hasn't been processed yet.

If married couple wanted to go to her country of origin for a visit this summer (Italy) - can they travel there and back before original expiry date of one year limit in Italian passport has expired?

Or would this jepordize the sponsorship process by doing so??

Bride/sponsoree came to Canada and they started application form her in Canada.

It doesn't sound like you applied using the inbound / inland process. If the application has been sent to the embassy overseas, then you applied using the outland (outside of Canada) process. The easiest way to tell is to let us know where you sent the application package. If you sent the application to Mississauga - you applied using the outland process. If you sent the application to Vegreville, then you applied inland.

If you did in fact apply using the inland (within Canada) process - then you are supposed to remain in Canada until the process is complete. There is nothing stopping you from leaving Canada during the process. However if you leave, there is no guarantee you will be allowed back into Canada. If you are not allowed back into Canada, this will effectively cancel your application and you'll have to start all over again from scratch.
 
To complete scylla's answer, if you have applied outland (Mississauga first, then file sent to Rome), then you're free to come in and out of Canada. please note that entry is never guaranteed into Canada, but if you're from a visa-exempt country, it shouldn't be a problem.

I'm not sure what you mean by the "original expiry date" of one year limit. Your daughter-in-law (from what I understand) has been given most likely a 6 months entry stamp at the border. If it has been extended for another 6 months, then it makes it 1 year, she can travel out of the country before that expires. It will re-set the clock when she comes back into Canada.

Sorry I may have gotten the wording confused a bit -they both returned to Canada after the wedding in ITALY and then sent off the sponsorship forms to Mississauga.

She is in Canada now but wants to go home to visit her family -so having said that would this be permitted or would it jepordize everything is she did that??

Any advise would be greatly appreciated

To clarify when she landed in Canada the immigration officer stamped a 1 year in her Italian passport
 
Then, since you have confirmed that your application is 'outland', she is free to travel in and out of the country. While it's true re-entry is never guaranteed, the application will not be in any sort of "jeopardy".

OK - it makes much more sense now.

This one year only applies as long as she remains in Canada. If she leaves Canada and then re-enters, she will be entering again from scratch as a tourist and will once again have to be assessed by immigration officers. In short, the allowance to stay 1 year is lost as soon as she leaves.

Regardless, none of this jeopardizes her PR application.
