He wants to sponsor me using the IR-1 so I can move to the US, I wants to sponsor him to move to Canada using a spousal Visa. Are we allowed to do this at the same time? We are either staying in Canada or moving to the US, not completely sure. But one of us will move. Any help is appreciated. Thanks!

No it is not possible. Now US and Canada share there immigration details and during the verification or back ground check if they figure out you are trying the double dross the immigration rule then you will treated under misrepresentation and will be banned.

To sponsor your spouse to Canada your prove that your intention is the settle in Canada and also need to give them your plan of action after visa is approved.

You can try one sponsorship at time... but remember there are certain period of time you obliged to spend in each country to maintain your PR status.

Um, no, i don't think this is true. while applying for both at the same time *may* result in rejection, it's not going to be rejected because CIC or the US believes they are trying to "double dross the immigration rule then you will treated under misrepresentation and will be banned." How ridiculous. Please stop giving "advice" becasue it's obvious you don't know what you are talking about.

as the other posted mentioned, the risk is neither government *may* believe you won't be able to meet the residency requirement, and that *could* result in rejection. Though i think it *is* possible to meet both at the same time, because as a PR in canada, as long as you are living with your spouse, you can be living anywhere in the world, and it WILL count toward residency requirements. For the us, I believe you must maintain residence in the US 6 mo. out of the year. So there is a chance there won't be any issue at all with approval.

Yes, it IS possible to apply for both at the same time, there is no law or rule against it. I am pretty sure there are plenty of people who do this. Whether people are successful doing this is another story. Unfortunately, i don't think this forum will be a good resource to determine how successful people are with it. It's really up to you if you want to try it.

As rhcohen has mentioned above, you can give it a go and try. The issue may lie with CIC more so than the issue of US Green card. PR is given to those who "intent" to reside in Canada permanently. It is going to be hard to convince CIC that you are intending to reside as PR when you got a green card application going through which tells CIC that you are not "intending" to reside in Canada. It would appear to CIC that you are trying to have it both ways. So your PR application may get rejected on account of not showing your intention to move to Canada when you got a green card application in progress telling CIC otherwise.
