Hello, my situation differs from previous questions. My husband has a 5yr ban from USA as of 2011. He was detained, sentenced, and deported as our family was trying to leave the US and enter into Mexico. In addition, he had a DUI for which he did not go to court or paid necessary fines for (this happened when he was a very young adult, 12 years ago). Now, he is currently living in Mexico. As many of you know, our family is broken because of this. I am a US citizen and so do both of our children. We would like to try anything possible do that our family can be reunited. Any chance he could be granted any sort/type of visa? I am currently enrolled in a community college and will begin classes this fall, but have not earned any degree yet.

It is not impossible but it will be very difficult because of the legal troubles that your husband already faced. DUI wont be any problem but the deportation and the ban will be a major issue for the visa office. You will definitely need a lawyer to assess the situation and give you the right advice. Best of the luck.

Violation of U.S. immigration law is not a felony and has nothing to do with immigration laws, DUI is a problem but still he was teenager at that time so he can get away with it
