Can I visit my husband while he awaits for his PR approval

My husband says that I have to be in Canada before him. I am - I moved back to Toronto last week. He is going to come visit me in October, but that is not enough for me since I miss him terribly. He says he is going to spend Christmas with his family (around the time where we should expect to hear whether he is approved or not) and come back around the first week of January. But, I actually want to fly over to where he is and spend christmas with him and come back to Toronto when he lands. He says I have to be in Toronto before he lands.

Is this true?

Is it because you are PR perhaps (not a citizen), and are supposed to be "in" Canada during sponsorship? Anyway, I'd still say a 'visit' abroad is fine.

I am the sponsor. My husband is the PR applicant. I wondered about that too. But I am currently living in Canada. I was living with my husband in Ireland but left while he's still there waiting for the entire process.

The question was whether you are a Canadian citizen or PR since different rules apply to each when you are sponsoring a spouse. Since you are a Canadian citizen, there are no real restrictions when it comes to sponsoring your spouse and being outside of Canada.

So again, there are absolutely no issues with you visiting your spouse over Christmas and then returning to Canada with him when he lands. There is absolutely no need for you to be in Canada ahead of him.

Ah in that case, then absolutely NO problem. My wife (the applicant) actually arrived in Canada about 12 hours BEFORE me, I booked my return flight (re my last visit there before 'landing') way after we booked hers, and ended up on a different airline.

Buuuut me being here helps though in terms of proving to CIC that I intend to reside in Canada when my husband gets approved. Im also back for other reasons. Its nice to know that I can spend xmas with him and be with him while he lands. Thank you!

Yes ok, that "might" be true for now, while he awaits the outcome of his application. However, when that time rolls around, and all he has to do is "land", then it won't matter that you arrive back in Canada with him, before him, after him, or not.
