Hello,
My husband is from Jamaica and he has been in Canada as a PR for 20 years. We married four months ago. He was charged with assault causing bodily injury...breaking and entry...he spent less than 6 months in jail (which we were told means that he could apply for an appeal) for his crimes but was held on immigration hold..it totalled 11 months. He was also charged again with uttering threats released the next day but held on immmigration hold for another 3 months..the first time he was charged with the assault made him inadmissible to Canada. He is still here with me as we are waiting to see if he can get a date for an appeal. We are also about to start a H&C application which we were advised to do. We also filled out a PRRA in July which we were told would be denied as 97% of applications are but we haven't heard back yet. My question is are we able to apply for sponsorship at this time? Or what is our best options at this time? He has had serious problems with alcohol and his charges all occurred during his binges..he has been advised that he has to go to in patient rehab for 30 days which he is going to in 2 months. My questions are does he have a chance at the appeal or are we just buying time? And are we able to apply for sponsorship at this time or will I have to move to Jamaica to be with him once the PRRA comes back denied?

What are you appealing? The criminal charges or the fact that CIC is revoking his PR status?

We are appealing the original removal order. They said he had the right to appeal because he served less than 6 months for the criminal charge. I'm getting conflicting information about the sponsorship so I wanted to know if we could start it or if there is anything else we could do at this time.

Has the loss of his PR status been confirmed yet?
