I am not a lawyer, but can say that that sounds like bad information.

Firstly, how you you apply to sponsor her as your common-law partner if you are not living together. That question is moot, because you've already disclosed that you were living together for 6 years and you did NOT disclose that in your own PR application.

Suggest you find a `different' lawyer and make sure you tell them the whole story!

You don’t have to be currently living together to file as common law. You have to prove that you are still in a relationship and that you have lived together in the past for over a year to apply for sponsorship based on being common law. The fact they have been common law but did not declare it on previous application will now the big issue.
 
so how people can be in relation ship less then 12 months get marry or even not (in canada) and go trough sponsor ship?

yes that's the situation i did mistake when i applied 4 years of immigration can make even disconnect between people and who knows after getting PR might be we back to be together .

You're not understanding. Getting married will NOT fix the problem that you have. You landed as a single person, when in fact you were in a common-law relationship. THAT is the issue that you may not be able to overcome.

We all [have] come here to `learn' how to navigate the myriad issues with a sponsorship application. I can speak for many others here in saying that NOBODY enjoys giving you the information you now have.
This is a very real problem for you and your partner.

Don't try to pretend that it's not.

The issue isn't about whether you are in a relationship for how long or married. You cannot sponsor her because you didn't declare her as your spouse or common-law partner when you applied to become a PR yourself. She would have to qualify thru other immigration streams.

Get a good lawyer as this can risk even your own PR status due to misrepresentation.

That's not a real question, that's a hypothetical facilitating denial of the situation you are in. Regardless, that is a different situation.

Your issue is not about your spouse being just 'refused' - you are looking at a lifetime ban on sponsoring your common law spouse (whether you marry her or not).

Speak to a lawyer.

We've given the OP the information that they need, even though it's not what they wanted to hear. It is now up to them to invest in their future.

Some things in life are important enough for qualified, expert help. We, are merely messengers.

To the OP: Stop trying to justify this by asking crazy hypotheticals. Either you want to try to resolve this (if even possible), or you don't. Imagine how devastating it would be to get married...apply to sponsor your new bride, only to find out that you CAN'T.
