Hi Everyone,

It seems because one of my husband's dependent has now had a child, I dont qualify under LICO, can I remove this child off application and when she gets her PR, she can apply for him once she established herself with a job etc..not sure what my options are here...if anyone knows please let me know
 
No it doesn't work that way. If the child isn't declared now they can never be sponsored. Is your stepdaughter or his sister (?) married or has she been living with her boyfriend for at least 1 year?

My Husband has 3 kids - 2 boys 1 girl, the girl got pregnant (20 years old) and had a baby a year ago (not with child's father either) - apparently LICO is not required when sponsoring dependents only, but now LICO comes into affect because its "dependents of dependents" but now my income doesnt qualify, so Im not sure if I can remove her baby from this application or not, my application has been received since January 10, 2014

No point in trying to remove the grandchild, as it makes no difference to the app. The daughter and grandchild are still legally considered dependents of your spouse even if excluded and therefore LICO applies regardless.

You can withdraw or expect the app to be refused. Reapply after the daughter turns 22 and ages out as a dependent. She would then need to qualify on her own to immigrate.

I sent in the IMM1283 as they asked for it even tho I dont meet the requirements, so I guess I will just wait for the refusal/denial..but what should I do in the meantime? she wont be 23 for another 3 years, will they do a removal order for him? this is an INLAND application, with a work permit attached :(

As I said, she ceases to be a dependent at 22, not 23.

He will not be issued a removal order if he follows the rules. He can apply to stay as a visitor before his work permit expires and try to continue to maintain his status but if he is told to leave Canada, he should.

2014? Four and a half years for an inland sponsorship seems very unusual. Is it possible that you missed an update on the application?
 
No, I didn’t miss any updates but they just requested so much information like medical, then a dna test, then medical expired, it’s been a long drawn out process...I got the denial now :(
