LANDED..........

Hi everyone,

I've asked this question before, but I think I wasn't specific enough.
(I'm the principal applicant)

From what I've read
1. COPR's are now sometimes granted quite quickly
2. the deadline of landing is the expiry date of the medical exam

Based on that, I might have a problem. If I haven't sorted out my life in my home country by the deadline, like leaving my appartment, quitting my job, getting my belongings ready to ship, is it a possibility to officially land in Canada and then go back home to sort everything out including still working until the date I've quit my job officially? From the logical point of view it can't be legal to be working in my home country while already landed as a PR in Canada, right? At least it feels like that to me.

I'm not expecting to get Condition 51.

If my guess is correct, I might have to cut it reeeeeeeal short.

Thanks for any advice.

Once you land, you can immediately leave Canada. You can actually remain outside of Canada for up to three years (to sort things out, for example) without risking your PR.

It's perfectly legal to continue to work in your home country after you land. You're not renouncing your citizenship (there); you're simply becoming a Permanent Resident of Canada, in addition to your citizenship `there'.

While a person can leave after landing as PR and continue working until end of employment contract, it is a form of misrepresentation. You are expected to leave and settle in Canada once you are given COPR. Not to leave Canada and come back 3 years later after landing as PR. If CIC caught wind of this, they would deny you PR status at landing. There has been some people being denied PR at landing due to applicant returning to complete university studies. They basically said, apply when you are ready to move to Canada, not before.

Well, I do want to move to Canada and live there. But my contracts are not just 10 days notice. I have a 3 month notice. So it might get really tight timing wise for me. But I don't plan on basically picking up my PR and leave to stay in my home country.

My concern was just whether or not it is illegal to keep working in my home country for a month or two after I've already landed. But I'm definitely moving to Canada after that.

@Ponga Thank you so much for your input :)

Usually your visa will have an expiration date so maybe you can give notice at work when you get your passport request so that way you will have enough time to quit your job and then land in Canada before the visa expires. Just a thought!

That is my hope. That I get my COPR about 3 months before the deadline which would be December. But that would be only 7 months after they've received my application.

Just asking, in case it is not.

When you do land, don't mention anything about having to return to home country to finish your work contract. They will surely deny your PR status.

Usually COPR is granted with an expiry date with lots of time left (medical one year anniversary). This is the time period they expect you to close up any issues before moving to Canada including employment issues.

When did you do your medical exam? Is your employment contract up before the medical exam one year anniversary date? If it is, then it is an non-issue. However if it is not, then follow advice I gave. Make no mention about returning to country to finish work contract.

I'm Belgian and my VO was Paris. I've got my COPR after 4.5 Months on the end of January this year. I also had to stay 3 months on my work after I decided to quit. So I came on May 3 to Canada.
If there are no issues or if you only have lived in Germany, that would make your background check easier.
I don't think that your application would take longer then 7 months if there are no issues at all.

I did my medical in March this year and sent the application in May, received AOR1 already. My work contract won't be up at any time, it is an open contract. I have to actively quit and they want 3 months notice. My landlord also wants 3 months notice for quitting the appartment.

I think our application is very straight forward. We've been a couple since 2006, got married 2014. I stayed in Canada for 9 months on a Work & Travel visa from 2012 - 2013. There are no red flags and we sen't tons of proof (not as excessive as some others though ;) ). I really hope we're gonna get an early Christmas present. That would leave me enough time for everything.

My wife did this. Her COPR came earlier than expected and she wasn't prepared to move right away. Fortunately she had 5 months before her COPR expired and that was more than enough time to wrap things up and move (she just needed 2 months).

I got to say 3 month employment notice is rather harsh. Good luck finding a job here to tell your new potential employer than you need 3 months notice to quit. They will just drop you like a hot potato and find someone else to come in 2 weeks time.

Two month notice is the norm for resident notice. Not sure why they need 3 months. You are suppose to give 2 month notice of leaving when you submit your rent payment. That would be your last rent payment since they already have your last month rent deposit when you move in.

Well I didn't make those rules, I didn't choose them. I don't like them either but that's what I have to deal with.

I know you didn't make the rules. I just hope for your sake, that there is a least 3 months left on your CORP before it expires after you receives it.

Even if the expiry date doesn't give you enough time, I think you can just do the landing, go back and wrap things up and come back 2-3 months later and it will be completely fine. I don't think you have much to worry about either way.
