Dear All:

I got my landing paper a couple of months ago and haven't landed yet. Now I am living in Canada. Last few days, I was charged with criminal harassment communicate( basically I am sending/calling this person too often). My question is: Can I go ahead and do my landing while I have a trial coming up in about a year. But the expiration day on my landing paper is October this year. What can I do?

Please kindly give me some advises! I really appreciate your help!

HI

Just wondering how you got on. I am in a similar situation myself. I was charged a few months ago with resisting arrest and now im awaiting trial. I received my conformation of permanent residence a few days ago. Did you get the residency in the end?

Thanks

When you land, you have to declare and sign that you haven't been charged/convicted. (I assume that this means undeclared already).
You can't do this, so yes, it will affect your landing. They may refuse to land you or you could commit misrepresentation by not declaring it. Bad either way.

Chances are that now you have been charged, this information has been sent to CBSA. So you may not be allowed to 'land' anyway.

Consult both an immigration lawyer and criminal lawyer. If you are convicted and the sentence is 6 months or more, you could be deported.
