Can I change my fiance status to OWP who is inside canada?

Hi everyone, I am coming in Canada as an international student and my fiance who is inside Canada as a caregiver submitted his PR and still waiting for result. Can I change his status from close work permit to OWP under my international student and make him Common-Law? I will be arriving to study in Canada this Fall 2021.

You would need to become common law first before he can apply to change his status to OWP.

In order to become common law, the two of you have to live together continuously for one full year and have evidence to prove you have this one year of continuous cohabitation.

Thank you for the reply. Just wondering if this can affect my fiance PR as a caregiver. Also we are going to live together can i apply him as a CLP during the duration of my study which will be a 2 years program.

Did you just become common law? Your common law spouse needs to include you in his PR application if you two lived together continously for 1 year.

Regardless if you try to apply for SOWP for him. I am not familar with caregiver PR application so I do not know getting SOWP (when it's approved) will affect his PR application.

Weve been boyfriend/girlfriend for 7 years. She is in canada for 2 years as a caregiver and ive been working in dubai for 4 years and will be coming this fall for student single applicant. We plan to live together when i arrive. So im planning to apply him as a common law after a year. Can she get sowp as well after a year?

Im confused with the use of “she” and “him”, and im not sure i get you when you said “apply him as a common law after a year”. If “she” was referred to the one who is caregiver in canada, i suppose she has work permit, and it could be closed one. May be when you graduate and become eligibe for pgwp, you can include her in your application provided you secure skilled job after your studies. At that time, you’ll attach proof of common law relationship. The issue is validity of her current work permit and validity after you graduate….you need to consider pgwp is issued once.

I dont advice you to apply to changer her WP status now. You were not in common law relationship,and i suppose she is not in your IMMI forms
