Can i apply under refugees categoery

HI GUYS,

I came in Canada 4 years ago as student , got open work permit after studies( Expired in 2015) ,in Dec 2014 i got married with a canadian citizen. she sponsored me in july 2015 and last month i got approval that my application is approved and they asked me for a police clearance certificate from india for further processing .i applied for that and waiting for it. after our marriage we got a kid who is almost 1 year old, now my wife starts fighting about money and other stuff, for her trust i transferred all i have in her account . now she is knows that i don't have enough funds, she is threatening me that she is going to withdraw the application and i think she can do that. In case she withdraw the file what will happen , will they depot me right away. can i apply under refugees for PR?. i don't wanna loose my kid. please help me as best as you guys can.. thanks

Are you actually a refugee or are you just trying to stay in the country?

i cannot go back to india. after i got married here my family don't wanna see me anymore because i went against them. my family wanted me to get marry with a girl who they choose for me.. when i denied all that ,they were angry, also that girl's family feel that they got insulted so if they will see me in india they can harm me. they are enough powerful to do anything to me, so i'm scared to go back

Unfortunately that's not grounds for refugee claim.

The best way is to consult a lawyer, he/she will be able to point you in the right direction. I mean from my understanding you have a child (Canadian born) so your case might have little bit of complication. See a good lawyer spend the $150-300 consultation fee and have peace of mind.
