Hi all,

My pgwp expired in Dec 2021. And now an 18 month pgwp extension will be offered to everyone with expired / expiring pgwp after Sept 20, 2021 till Dec 31, 2022.

But after my pgwp expiry, I had transitioned to a LMIA based closed work permit.

Am I eligible to apply for the 18 month pgwp extension?

No, you won't be eligible. The extension is for individuals with PGWPs expiring in 2022.
 
They extended the eligibility criteria recently. Please check the below link of a tweet from immigration minister:

Ah - I wasn't aware of that. That's going to be great news for many.

I don't know the answer to your question in that case. I don't know how they will treat your situation since you moved to a closed work permit. I see no harm in trying.

The rules and regulations pertaining to the extension have not yet been published and will be on the website in the next few days. If you meet the eligibility criteria, you can surely apply.

But nowhere it seems to mention whether the people who have transitioned to a closed work permit can apply for a PGWP extension.

In this LINK too its just mentioned that people with a valid work permit are eligible to apply without restoration. But it doesn't specify whether LMIA based closed work permit holders are eligible.

I don’t think they are going to specify who can or cannot apply, imagine all the different scenarios that they would have to clarify (LMIA work permits, LMIA exempt, BOWP, spouse work permits, IEC work permits etc.)

The eligibility criteria is pretty clear, as long as you meet the eligibility criteria you can apply. If they were going to exclude someone, I’m sure they would’ve added something as part of the eligibility criteria (for example, “you are currently not working with a valid work permit, different from a PGWP”). Think about this from the immigration officer perspective, the instructions he/she has say the following:

1. The applicant holds or held a PGWP that expired sep/21 to Dec/22 (yes/no)
2. The applicant specified that they are applying for the special policy (yes/no)
3. The applicant has a valid passport (yes/no)
4. The applicant has a valid temporary resident status or is applying to restore it (yes/no)

If you answer yes to all, then you are good to go. If holding a study permit is valid as a temporary resident status for this policy, there is no reason to believe that holding a new work permit (no matter which one) will be treated differently.

If you still have some doubts, just don’t rush it. Wait for the letter that is coming next week, if you get it then there’s the proof that you are eligible.
