Can a person without status in Canada submit an Outland application?

Makes sense. In order to apply for nexus, a valid passport is required. So they probably able to pull up passport info through the nexus card. Question is this. Can a person continue to use the nexus card pass the passport expire date even though the nexus is valid? Curious here.

The nexus card is valid for 5 years from your next birthday at date of issuance. if that is of any help to you Screech. LOL

I'm sure you are talking about the cards being 'proof of citizenship' if issued after Sept 2010, however that only works if you are a citizen of either the US or Canada. If you are neither and only a PR you must carry a passport as well.

I am out of status...and cibc issued removal order...I did send my application before that phone interview...super fast and rushed(Ponga knows all about that lol)...so there might be a chance they will leave me alone since my app is in process?? maybe...

I recently moved to another city and called cibc officer right away to give them my new address as they requested...so maybe that scores me some Good will points haha

We've actually seen cases where CBSA has started the removal process on someone, the person then submitted an inland app, and CBSA backed off. So obviously it's taken into consideration in removal cases.

generally no, unless you are out of status for like 10 years, or working when you shouldn't be.

I doubt it. Most likely the the kiosk will flag you with an outdated passport when it pulls your records and then send you to secondary inspection. Then you would have to pull out an updated passport (assuming you have one and just forgot to update NEXUS) or they send you back.

Ah ok. I got mine on 2011 and I had a US citizenship at the time (I am dual now) so that explains why NEXUS officials told me I didn't need my passport when crossing at a land border.

Did you notice that the Inland application guide states that a person no longer needs to maintain legal status to apply?

Did you ALSO notice that the next sentence says that a person can still be removed at any time?!?!

I don't see how anyone can guarantee that you will not be removed. The chances may be small, but it's still a possibility. At the very least, you need to submit your application ASAP!
 
I am trying but i have a son of 4 years old i am terrified of loosing. I am filling the application as we speak.

From all of the comments made on here by those who have dealt with immigration lawyers, I wouldn't advise anyone to see one lol. Perhaps there are a few extremely experienced and knowledgeable lawyers out there who may be familiar with this situation but I doubt it.

Legal status has nothing to do with living. That sentence I quoted: If they live in Canada, they do not need to have legal status to be sponsored., shows that CIC is well aware that there are people without status living in Canada. There are members on here who have been out of status for years, living with their spouse, raising their children, having a home, community connections etc. Would you say that despite all of that, the fact that they are out of status means they don't actually live here?

Regarding other members' opinions, I believe that computergeek is the only senior member that I've seen disagree. Everyone else, including members like scylla and Rob_TO, have agreed.
