Dear Friends

Can a father sponsor his children which he did not claim to exist at all? The father is a Canadian permanent resident, and children are in refugee camps. He did not have with him, when he was coming to canada and he was only afraid they may delay his case if he could have claimed that he had children. How can he sponsor them now.

He can't... Not only that, but he could also be accused of misrepresentation, and possibly lose his own PR.
 
I'm pretty sure that if the father did not disclose that he had this children when he came to Canada, he cannot sponsor them. To add further, it means that he misrepresented himself in his own PR application, which is NOT a good thing to do.

Perhaps there is an option under H&C, but I'll defer to others that will know for sure.

So basically a male foreigner applying for PR would have to contact every female he has slept with to be sure he hasn't fathered a child. This way he cannot claim he didn't know there was a child conceived.

In this case, it's very clear that a) He knew about them, and b) He chose to exclude them to suit his own purposes.

Agreed. He wanted to expedite the process for himself and did this at the expense of never being able to sponsor his children. Parenting fail to the highest degree.

I know that what I wrote doesn't apply to him as he knew he had children. He basically misrepresented himself to push his own needs above his children.

But the quote I made was just an afterthought of having to report / declare all children in PR papers.

Case law found on CANLII actually has examples of this scenario. It's treated sympathetically...

Agreed again. There's a chance if a father didn't actually know the children existed. However this has to be proven.

The part that is the most painful is that he was afraid that they may delay his case...

What's worst is that his children are in a refugee camp at the time and probably are still there.

Looking at the OPs older posts, it is a bit... confusing. Older posts mentioned that the father didn't know what he was signing or he didn't put them in because he couldn't find their photos. not sure what the real deal is here.

Oh, I read the post to say that the children are NOW in a refugee camp. If they were there when he was applying for his own PR, you're right...that's much worse. :(

I imagine the man is really struggling with this issue right now.

I read the other posts too .I am thinking she is asking for different people . May be she is there Representative and just trying to help friends out ...
