Hi,

Hi,

So you posted the job and cannot find a Canadian with the education, work experience and language skills to do the job? What is the NOC, wage and location? What does this person have when you can hire Canadians with MBAs and business expertise?

Need a positive LMIA from ESDC before your candidate can get a work permit, which proves no qualified Canadian was available for the role. 2026 enforcement is tight, and your struggling business is the main risk since ESDC checks financials and can flag it as an immigration vehicle rather than a genuine need. The best route is likely the Owner Operator LMIA, which applies if the person is buying into and actually running the business rather than just being hired. This needs a real business plan and proof of active management involvement across staff members and locations, showing the role has genuine operational substance rather than existing on paper alone. An alternative is an Intra Company Transfer, which skips the LMIA entirely, but only works if there's a genuine existing corporate link between an Indian company and yours.
