Hello,

If a person is on Employment Insurance, is it possible to apply for BOWP and stay on implied status to receive the benefits? BOWP would not have AOR or any nomination to complete the application but just to buy few extra weeks???

Please advise.
 
I don't know if it's possible.

However if you do receive EI payments, it's possible you may have to repay them due to how CIC is now processing BOWP applications for people who don't qualify for them but apply anyway to try to get implied status. Assuming CIC follows their new process, your application will be rejected and you will be out of status in Canada from the day your original work permit expired (not from the day the BOWP was refused) - and you won't have had implied status at all. People who are in Canada without status don't qualify for EI - and so any EI you receive past the expiry of your work permit will have technically been obtained fraudulently.
 
Good point. Thanks for the input. Another question if you may answer: if my PGWP expires on Oct 30 and I am still awaiting a reply on my Masters application which is expected to reach a decision perhaps 1st week of November then what should I do?

- wait and apply for restoration to a student once I receive an acceptance letter in November after my WP is expired?
- or apply as a visitor before my WP expires to stay in status and again apply for a study permit in November?

Definitely apply to change your status to visitor before your WP expires. Restoration applications can take many months to process. If you go the restoration route, the application may not be processed soon enough for you to start classes in January.
 
I was receiving EI and my PGWP was expiring while I was still eligible for payments. I applied for BOWP and submitted a copy of thwas once it was approved, I continued receiving EI payments. But I'm not sure you can continue receiving EI payments under implied status, you must have a valid work permit.

Different situation - you were eligible for a BOWP, the OP is not.

OP just wants to apply for a BOWP to try to buy some time on implied status before it is refused. However, IRCC now returns "incomplete" applications to prevent this; if this happens, there is no implied status.

Does it means that until you have R10 Completeness check done, you cannot apply for BOWP? Lets assume if I submit e-APR couple of weeks before PGWP expiry date and then apply for BOWP through paper application to buy in time to wait for R10 completeness check. Will it still be considered incomplete application & thus, rejection?

If BOWP gets declined due to non-compliance of R10 Completeness Check after couple of weeks, when does the Restoration period starts? a) when your PGWP expired b) The day BOWP application is declined

Hi,
you can apply for the BOWP with your AOR. The CIC is (usually) processing the BOWPs when the completeness check (R10) is done .
