Hello
I have been selected out of the pool for residency. However My visa runs out in 8 days time. I have applied to extend my stay in Canada visa (BOWP) and It is saying it in being processed. I have been told by my HR department that I am meant to apply for this visa after receiving the invitation. And the one I have applied for may not give me a valid status to work while I complete my residence application. Is someone able to answer if I need to apply for a new BOWP or will there system link that I have received an invitation and give valid status. Until I am able to finish the application? This may sound confusing.
Thank you

Hi

Receiving an ITA does not qualify you for a BOWP. You need to actually apply for PR first. As you have submitted a work permit application without qualifiying, IRCC will likely reject it as incomplete. This would mean that any work done in the meantime after your current permit expires in 8 days would be illegal.

So I need to have submitted my application for PR before I am able to apply for my BOWP? The invitation itself doesn't allow you to qualify for a BOWP? and while you wait for an answer on the bridging visa you cant do anything?

It seems you haven't really done any research on this process. I suggest you start reading.

https://www.canada.ca/en/immigratio.../extend-permit/bridging-open-work-permit.html
You may be eligible for a bridging open work permit if:
  • you applied for permanent residence
  • your current work permit expires in 4 months or less
  • you have valid status on your work permit
  • you are currently in Canada
I have read this section above quite a few times. And it doesn't specify If your application is an invitation and finished that process or just being accepted into the pool. Hence why I am unsure and thought I had done it correctly. As i have applied for residency and currently all above are correct. And any other information I read said that once you applied to extend your visa you were ok until you heard back, if that incorrect I don't know.

The key point here is that you have NOT applied for PR and therefore fail to meet the most basic qualification.

Applying for PR = actually submitting the completed PR application. Applying for the pool or receiving an ITA does not count.

Thank you a clear answer. I appreciate your help.

I suggest you apply to change your status and extend your stay as a visitor before your current work permit expires. Do not let yourself go out of status.
