yes I did applied online, they have mentioned 'You have not provided evidence that you have received a positive eligibility decision on your PR application' as one reason and secondly I have a another permit valid until end of 2014 from a different employer which I wont be using as the employer is not offering job anymore.... I explained the situation in the covering letter clearly but the VO did not pay a heed to it and refused my application... my WP which I am using is expiring in another 2 months... not sure how do i proceed....? Could you guys pls suggest as I would be without Job after 2 months if I dont get Open WP?

no, I don't think it will impact your pr at all. They are separate applications.

yes, i did attached aor as an annexure with the covering letter. could you guys help and suggest if there is any alternative for my situation? can i request cic to withdraw the wp issued to me for different employer valid until end of 2014 and reapply for BOWP? is that an option?

Looking at this information it seems like you have a valid WP until end of 2014 thus making you ineligible for BOWP.
In order to be eligible for BOWP your current WP must be expiring within 4 months and you have your AOR.

You also cannot withdraw/cancel an issued WP. You need to apply a new one which require you an LMO so it is a long process.

It is very confused that cic did not notice the aor attached and rejected the application on that basis? Kinda worried mine now.

have you make clear ref in your cover letter you attached the aor? Just don't understand how come cic could miss it?
 
thank you for yr reply. going through new LMO is a lengthly process and could take upto 5-6 months... by that time i would expect my PR appln to be near processing.... what happens if I leave Canada.... does that impact PR application in process from within Canada (CEC class)?

Second info: here it implies that you have a WP valid until end of 2014

I do not know which one is correct. Normally if you have a new WP the old WP will automatically becomes void/invalid.

If A: your WP is expiring in the next two months
- Then you should be eligible for the BOWP and explain them that AOR was attached and you can even see it on your mycic account.

IF B: your WP is valid until end of 2014
- Then you are ineligible for the BOWP (you will only qualify if your WP will expire within 4 Months and that you have an AOR).
- The only question I have here is why they reject you on the basis of no AOR?! The rejection should be based on ineligibility for BOWP.

Lastly, you cannot cancel/withdraw and existing WP. You can only replace with a new WP that is applying for a new one which means getting an LMO and go through the lengthy process of WORK PERMIT APPLICATION.
Alternatively, you can change your status to Visitor but this will not allow you to work.
 
hi... both the info is correct... I am working with the WP for employer A which is expiring in 2 months... and have another WP LMO based for employer B which is expiring end of 2014.... My immigration consultant/CIC call center both confirmed the WPermits are valid till the date of its expiry...as long as you dont work for both the employer at the same time...there is no mention about this anywhere on CIC website or anywhere which states that the second WP invalidates the first one... do you know anything?

On my BOWP - they did said your status in canada is valid until end of 2014 which I assume was the ineligibility criteria as well. I did explained in the covering letter that I wont be using the other permit as the new employer is not offering the job but that was not counted in by the Visa officer.

changing my status to vistor or staying back in Canada with the second WP wont help as I will be without Job for 6-8 months by the time my PR is processed.... only option i see is to go back and come back after taking my PR. I am not sure if going back from Canada would impact my PR process?
 
Hi canada.msn, as I can recall, your close wp overrides the bowp. Regardless your prospective employer has the job for you or not, your wp is still valid till Dec 2014, I hope this is the only factor to make your application ineligible by cic.

Re the question of your return to your home country, don't worry about it at all, it will no way impact your pr. Just need to update the cic your new address. Also depending on what country you are going to reside, you may have some concern to send your passport for visa unless you are from visa exempt country. Good luck.
