Birth Place Issue

My friend is also applying for permanent residency under CEC.His passport birth place is different from the birth certificate.
We went indian passport office in Toronto. They said to get the court order from India. He is working in Canada and he has no vacation to go to India to change it.He doesn't know how much time it wll take to correct it.
He is so worried. if he didn't correct the place of birth in his passport,will they reject his PR.

Please advice what he can do,

Ideally no one knows if the application will be rejected based on this or not, but if there is a discrepancy in the information/documents provided, you have higher probability of not passing the initial stage. I have seen people applying with Affidavit in such cases, but those were mostly the cases with the Name and not the place.

IF there is no go, then would recommend to apply with an affidavit stating the reason of discrepancy and what is the correct birth place along with the application. Mostly it should be accepted.

If that is true, why did he not get passport corrected when he first received it. He has even traveled with it, that itself is wrong. Anyway, ask him to create a sworn affidavit by contacting a lawyer who can notarized it as well. Submit the affidavit to BLS and get that corrected by getting the endorsement on passport.
At toronto there are some agency who would say they would do it for cheap. Ensure that when they sign your affidavit they sign it and put round gold seal which is embossed with their registration number. My friend had to make another run to lawyer because he missed that embossed seal.

There is one more option-- submit passport and dont submit birth certificate, they need proof of dob for that u can submit translated copy of ur highschool marksheet.

while filling forms put what is place of birth in passport , i hope that should work, in this way there will be no descrepency in documents u submit to cic, CIC is not going to check every small village/town that exist in india, i think purpose is there should not be contradictory info in ur application.

I want to know if he get his new passport, is there any problem to come back to Canada with his work permit and visa. He has his visa on his old passport that has wrong birth place.
Do he has to show any other document when he reaches in Canada Airport.

His old passport will be returned and that can be used to return to Canada.

He would need to have the visa on the valid passports. If the passport number changes(old passsport is cancelled) he will need to go to the Canadian consulate and get the visa on new passport and other necessary docs..

My US visa is on my cancelled passport. I have traveled numerous times into the US with it.

Look at section 13.15 in ENF 4 : http://www.cic.gc.ca/english/resources/manuals/enf/enf04-eng.pdf

Valid Visas in expired passports. You can still use valid visas in old passports.

I agree with vpatkhag comments. Submit HIGH school certificate ( must be having either parents name included) as a proof of DOB. Explain in cover letter that you do not ave birth certificate and you are providing secondary school certificate as a proof of DOB. This is what i did in my case.
Acceptable document for CIC is : Secondary school certificate having either of the parents name included as per the CIC returned letter. Place of birth is not mandatory and i have one case where birth certificate and passport place of birth was different ( bangalore vs mangalore), which went un noticed and guy is PR now...So better avoid this confusion and explain in cover letter that you have no birth certificate and hence providing school certificate as a proof. This will work without any issues.
