Hello,
I am helping a student in her situation. she is originally form Iraq. she came to Canada with her mom as a convention refugee. Originally, the student and her family "mom and dad" moved to Lebanon and register with UN as A refugee. a while after, mom and dad get divorce and separate their applications. the parent get back together through a religious marriage certificate before the UN send my student and her mom application to Canada. they came to Canada and try to bring the father, however, UN refuse to relocate him as he seems to settle very well in the asylum country Lebanon. my student is 17 years old and her mom become sick and not in a good mental health. they are struggling in life in Canada. the student want her dad to live with them. she can't take care of her mom and her schooling. they are in a tough situation now moving from city to another listening to people give them false hope. how can she bring her dad. we try the 5 group sponsorship but they couldn't find people. they don't have family or close friends to help them with that. we tried joined sponsorship or through a church, if they have money, each has their own requirements that doesn't fit with my student and her mom. i was thinking to put an H&C application. I know that the new regulation saying the person has to be in Canada. the father have the ability to support the family, he is working in Lebanon and actually he send them some money between and then. however, the child need her dad presence and metal support. she is trying to get a job but is hard and her mom need much attention from her. and of course she is still in school.

The father doesn't qualify for H&C based on the information you have provided since he's not in Canada. The application has no chance of succeeding unless he's here. Does the father qualify to immigrate independently (e.g. through the skilled worker or skilled trades program)? That's the only immediate option I see.

Otherwise the daughter will be able to sponsor her father through family class once she turns 18 and has three years of CRA tax returns that prove she meets the minimum income requirement to sponsor a parent. If she's 17 and currently still in school, this means she's unfortunately still 4-5 years from being in a position to sponsor her father.
