Hello everyone,
I have almost completed putting all my documents together for my application that I aim to send out by the end of this month.
Before I do so, I need advice on the following:
It is with regards to question 6 (J) on the BACKGROUND DECLARATION FORM which states that "Have you been detained, incarcerated or put in jail?"
Before I begin my story, I want to tell you and clarify that all my police clearance checks for India and France are all clear and neat.
Here is my story:
When I first moved to PARIS (My ex-wife is French and we used to live in the South of France prior to deciding to move to PARIS - I had a resident and worker permit in France because I was married to a French National) to look for a better paying job and a better life.
I was a paying guest at this man's apartment, it was a very tiny room but in a very good location and walkable distance to everything which is what i needed.
I immediately paid him the advance deposit and moved in, I used to mind my own business and he minded his own.
But after a month or so, he asked me to leave and find another place as he was having some family or friends over and that he would be needing the room that I was in - because it is PARIS, it is very difficult to find something right away and i was unable to find alternative accommodation at all, he kept on forcing me to leave, and I told him that I cannot for a moment cause I have no other place to go - he did not listen!
So he made a false complaint to the police that we had a heated argument and that I harassed him and then the Police detained me and kept me in detention (police custody) for 3 days, and then I am not sure what happened, but the man apparently had a 'call of his conscience' so he came back to the police station and withdrew his complaint 100% and then I was released from detention.
Because he withdrew his complaint complaint and the case was dismissed there was no record against me and my PCC for FRANCE is all clear and there is nothing on the records.
The issue is this:
I know that I have to mark "YES" to question 6(J) ("HAVE YOU BEEN DETAINED, INCARCERATED OR PUT IN JAIL") because I was detained and then provide an explanation. But, since I have a PCC from FRANCE which is all clear do I still need to provide an explanation and mark the answer as "YES" ?
OR
(since my PCC for FRANCE is all clear) should i mark "NO" for question 6(j) and still provide a written explanation, telling the immigration officer that since my PCC for FRANCE was all clear, i was not quite sure how to answer question 6(j) and therefore I am providing a written explanation letting him now that I was detained for 3 days in 2006?
Please advice.
I know that this seems like a lot of drama that I don't need right now, but any help, guidance and advise would be greatly appreciated.
