Current situation:
I'm in US on H1B visa. My visa stamping is expired.
My H1 will expire on 12-Jan-10. I have the I94 attached to my H1 papers (and ofcourse the expiry date is 12-Jan-10).
I have applied for my H1 renewal.

I have received Canadian PR approval & I have to make landing before 4-Jan-10. I'm planning to land with my family on 31-Dec-09.

Can I come back to US on the same I94 card (without visiting the US consulate and getting the stamping done). Will there be any issues.
Please advice.

Thanks,
Jay

hi,

I think there is a provision of 30 hrs .. u can go to canada and come back to US in 30 hrs with no stamping ....
I m not sure about this .. but long back someone did this .... u should serach about it

I visited Canada for two weeks as vistor before from US (I was F-1 visa holder, F-1 expired). No problem to come back. For F-1 I need I-20 though. Not sure for H-1 holder, what legal document you need to take with you. So if you stayed Canada for less than 30 days, it should be fine without stamp.

However, I am not sure if you go to Canada for landing, it is still the same.

Please keep me posted if you know the solution.

THnaks a lot,

I believe it is 30 DAYS not 30 hours. It is known as automatic revalidation.
