IRCC was taking forever in the processing of her study permit so the school revoked her admission and refunded just 50% of her tuition fee deposit. They ceased communication with her and refused to provide her a new letter of acceptance so she had to withdraw her ongoing study permit application.

The refund policy states that
"If an international applicant’s Study Permit is denied and a copy of the denial letter is received by the Office of the Registrar, the program deposit will be refunded in full."

However in her case, the school refunded 50% of her deposit and her admission was revoked during the processing period of her study permit, so she had to withdraw her
study permit application. What she has is a withdrawal letter and not refusal letter. The school is refusing to provide her a full refund on that note. Pocketing $5,000.

Does she have a case?

It appears they refund full deposit in situation where SP is refused and refusal letter provided. In her case, she could not secure spot by providing SP and they revoked her acceptance letter

This was a situation that was totally out of her hands. Revoking her admission implies the letter of acceptance submitted to IRCCC was no longer valid. She had to withdraw her application because she was not given the option to defer. You think the school are right not to give her full refund?

Did the school have a deadline for which you can withdraw your admission in order to get full refund? Most schools do. If your sister knew this date, she should have voluntarily withdrew her admission latest by that day, knowing she runs the risk of loosing 50% of her fees if she didn't get her SP before that date.

Why was she not given an option to defer? Was that clear on the policy from the beginning? The school's refund policy is clear - full refund if refused. She was however not refused yet and the intake already begun (and I'm guessing she didn't start classes), hence the revoking of her admission.

It's hard to apportion blame here as the school followed their policy.
