Australian with a DUI wanting a working holiday visa. What are my options?

Hi.

I'm 21 from Australia wanting to travel around Canada for at least 6 months. Apart from a 4 year old drink driving charge (BAC 0.981) I have a clean criminal record and traffic history. I've been to Canada twice in the last three years and had no problems. What are my options with getting a WHV?

You're inadmissible to Canada right now. Presumably you were able to enter Canada previously as a visitor becuase immigration didn't ask you if you had any criminal issues - or they asked you but you didn't tell them about the DUI. However the DUI definitely makes you inadmissible for five years since the date you completed your sentence (whatever punishments you were given - fine, probation, etc.). And if immigration had been aware of your DUI, you would not have been allowed to enter Canada the two times in the past. You would have been sent home.

If you're interested in applying for a working holiday visa, you'll need to wait until five years have passed since the completion of whatever punishment you were given for the DUI.

You can apply for expunge of your DUI charges in your country with the help of an attorney legally and then you can apply for your holiday visa permit.. This makes the work very easy for you.. As attorneys have best and great experience you can easily come out of all criminal records..

After it has been 5 years or more you'll be able to apply for criminal rehabilitation and if approved your DUI will not affect your travels in and out of Canada.
However, since it has not been 5 years yet you can apply for a temporary resident visa, which will help you temporarily overcome your criminal inadmissibility and allow you in Canada temporarily.
After you have done that I am pretty sure you should be able to apply for a temporary working visa.

Whatever you are smoking must be pretty strong.
You can't just "expunge charges"...

I'm also from Australia and had a BAC similar to yours which was two years ago. I attempted to apply for my work visa but it was denied because of my past. I've had a clean record since as well. How did you go with your work visa? I've surfed the net about expunging the offense and have some doubts about it.

You can't expunge. You'll have to wait for another three years before you are no longer inadmissible and only then will you be able to apply.
